1. Acceptance of Terms

By downloading, installing, or using ThenFocus ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.

These Terms constitute a legal agreement between you and House of Then, LLC ("we," "us," or "our"), a Delaware limited liability company.

2. Description of Service

ThenFocus is a focus timer application enabling users to:

• Time focus sessions using proven methodologies (Pomodoro, 33:33 Eugene Schwartz method, Gimme Five)
• Set daily session goals and track progress
• Block distracting apps during focus sessions using Apple's Screen Time API (premium feature)
• View session history and focus patterns through heatmap visualization
• Receive optional notifications for session completion and focus reminders

The App functions as a tool for building and maintaining focused work habits through structured timing and distraction blocking.

Core Features (Free)

• All three focus protocols (Pomodoro, 33:33, Gimme Five)
• Session logging and tracking
• Today and yesterday session history
• Heatmap visualization of focus patterns
• Session completion notifications
• Daily goal setting

Premium Features (ThenFocus+)

• App blocking during focus sessions
• Full session history and analytics
• Custom protocols with personalized durations
• Session notes and tags
• Priority support

3. User Accounts

No Account Required

ThenFocus operates without requiring user account creation. Your data is stored locally on your device and identified only through anonymous device identifiers for premium subscription management.

Premium Subscription Management

• Subscriptions are managed through your Apple ID
• RevenueCat handles subscription verification using anonymous identifiers
• No personal account information is stored on our servers

4. Premium Services (ThenFocus+)

Prices may vary by region and are subject to change. Current pricing is always displayed in the App Store.

As an alternative to ThenFocus+, you may purchase ThenBecome, a suite subscription that unlocks premium features across all Then apps (ThenCommit, ThenAudit, ThenFocus, ThenObserve, and future ThenBecome suite apps).

ThenBecome is subject to the same billing, renewal, and refund terms as ThenFocus+. If you subscribe to both ThenFocus+ and ThenBecome, you will be billed for both subscriptions. We do not have the ability to cancel subscriptions on your behalf, and you must do so yourself. ThenBecome includes all features of ThenFocus+, so a separate ThenFocus+ subscription is not necessary when subscribed to ThenBecome.

Billing and Renewal

• Payment is charged to your Apple ID account at purchase confirmation
• Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
• Renewal charges occur within 24 hours prior to the current period's end
• Manage subscriptions in your Apple ID Account Settings

Free Trial

New users may be offered a free trial period. If you don't cancel before the trial ends, you'll be automatically charged the subscription price.

Refunds

All purchases are final. Refunds are handled according to Apple's App Store policies.

5. App Blocking Feature

IMPORTANT: READ THIS SECTION CAREFULLY BEFORE USING APP BLOCKING

The app blocking feature uses Apple's Screen Time API (Family Controls framework) to restrict access to selected apps and app categories during your focus sessions.

User Acknowledgment and Responsibility

By enabling app blocking, you acknowledge and agree that:

1. YOU ARE SOLELY RESPONSIBLE for your use of the app blocking feature and any consequences that may arise from blocking apps on your device.
2. You understand that blocked apps will be truly inaccessible during focus sessions until the session ends or you manually disable blocking through iOS Settings.
3. You have been informed how to disable app blocking at any time by going to iOS Settings > Screen Time and removing ThenFocus's Screen Time access.
4. You will NOT enable app blocking if doing so could:
   • Prevent you from receiving emergency communications
   • Interfere with critical work, medical, safety, or legal obligations
   • Block apps necessary for your health, safety, or welfare
   • Cause harm to yourself or others
5. You are responsible for ensuring you can access any apps necessary for emergencies, including but not limited to phone, messaging, and medical apps.
6. House of Then, LLC IS NOT RESPONSIBLE for any damages, losses, missed communications, missed opportunities, emergencies, or other consequences arising from your use of the app blocking feature.

Emergency Override

You can always disable app blocking immediately by:

1. Opening iOS Settings
2. Going to Screen Time
3. Finding ThenFocus under apps with Screen Time access
4. Toggling off Screen Time access for ThenFocus

This immediately unblocks all apps regardless of whether a focus session is in progress.

Limitation of Liability for App Blocking

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSE OF THEN, LLC SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR CONSEQUENCES ARISING FROM YOUR USE OF THE APP BLOCKING FEATURE, INCLUDING BUT NOT LIMITED TO:

• Missed phone calls, messages, or communications
• Inability to access apps during emergencies
• Work-related disruptions or missed deadlines
• Financial losses
• Personal injury or property damage
• Any indirect, incidental, special, consequential, or punitive damages

YOU USE THE APP BLOCKING FEATURE ENTIRELY AT YOUR OWN RISK.

6. Focus Methodology

Protocol Options

• Pomodoro: 25 minutes work, 5 minutes rest
• 33:33 (Eugene Schwartz): 33 minutes 33 seconds focused work
• Gimme Five: 5 minutes quick focus sessions

User Responsibility

The focus methodologies are self-improvement tools, not professional advice. Results depend on your consistent use and honest self-assessment. The App does not guarantee specific productivity outcomes or behavioral changes. You are responsible for choosing appropriate focus durations for your situation.

7. User Conduct

Users must:

• Use the App only for lawful purposes
• Not attempt to reverse engineer, decompile, or hack the App
• Not use the App to harass, harm, or violate the rights of others
• Not circumvent or manipulate subscription verification
• Not share or distribute premium features to non-subscribers
• Use the app blocking feature responsibly and safely
• Comply with all applicable laws and regulations

8. Intellectual Property

Our Property

• The ThenFocus name, logo, and branding
• The App's design, interface, and user experience
• All code, algorithms, and technical implementations
• Marketing materials and documentation

Your Content

You retain ownership of your session data, notes, and preferences. By using the App, you grant us a limited license to process your data as necessary to provide App services.

Feedback

Any feedback, suggestions, or ideas you provide about the App may be used by us without compensation or attribution.

9. Privacy and Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the App, you agree to the Privacy Policy.

11. Health and Wellness Disclaimer

IMPORTANT: ThenFocus is not a medical or therapeutic device. It is not intended to diagnose, treat, cure, or prevent any condition or disease.

• Do not use the App as a substitute for professional mental health care
• Consult healthcare providers for health concerns
• The App is for productivity and self-improvement purposes only
• We make no claims about health or wellness benefits
• If you experience distress while using the App, discontinue use and seek professional support

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR RELIABILITY OF CONTENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that:

• The App will meet your requirements
• The App will be available at all times
• Data will never be lost or corrupted
• All bugs or errors will be corrected
• App blocking will work perfectly in all circumstances

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSE OF THEN, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OPPORTUNITIES.

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

Some jurisdictions do not allow these limitations, so they may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless House of Then, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App, including the app blocking feature
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you create or submit through the App
• Your violation of applicable laws or regulations
• Any consequences arising from your use of the app blocking feature

15. Changes to Terms

We reserve the right to modify these Terms at any time. When changes are made:

• The "Last Updated" date will be updated
• In-app notification will be provided for significant changes
• Continued use after changes constitutes acceptance

If you disagree with changes, stop using the App and cancel any subscriptions.

16. Termination

Your Rights

• Delete the App from your device at any time
• Cancel any active subscriptions through your Apple ID settings

Our Rights

We may terminate or suspend your access for violations of these Terms, fraud, abuse, or upon legal requirement.

Effects of Termination

• Your right to use the App ceases immediately
• Local data remains on your device until you delete it
• No refunds for unused subscription time (per App Store policy)
• Sections intended to survive (e.g., Limitation of Liability, App Blocking disclaimers) remain in effect

17. Governing Law

These Terms are governed by the laws of the State of Delaware and the United States of America. Any disputes shall be resolved in the courts of Delaware. You waive any objection to jurisdiction or venue in these courts.

Arbitration

Any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association.

Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class or representative action.

19. Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and House of Then, LLC regarding the App.

Severability

If any provision is found invalid, the remaining provisions continue in full force.

Failure to enforce any provision does not constitute a waiver of that provision.

Assignment

You may not assign these Terms. We may assign them without restriction.

Force Majeure

We are not liable for delays or failures due to circumstances beyond reasonable control.

By using ThenFocus, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including the app blocking disclaimers and limitations of liability.

ThenFocus operates on a local-first model where your focus session data is yours alone. All session history, preferences, and progress are stored on your device by default. We collect only essential information for delivering core and premium functionality.

• Premium subscription identifiers through RevenueCat (never payment details directly)

• Device type and iOS version for compatibility
• Optional anonymous crash data through Apple's standard reporting
• Subscription status verification via RevenueCat

3. What We Do NOT Collect

• Location data
• Behavioral analytics or advertising identifiers
• Health data
• Contact lists or biometric information
• Information about which specific apps you block (this is processed entirely by Apple's Screen Time API on your device)
• Your browsing history or app usage outside of ThenFocus sessions

4. How We Use Information

Core Functionality

• Local storage of focus session history and preferences
• Premium status processing through RevenueCat
• Local notifications for session completion and focus reminders
• App blocking coordination through Apple's Screen Time API (processed entirely on-device)

Support and Improvement

• Responding to user support inquiries
• Fixing bugs identified through crash reports

• Improving focus methodologies with explicit consent for anonymized patterns

5. App Blocking and Screen Time

How App Blocking Works

ThenFocus uses Apple's official Screen Time API (Family Controls framework) to enable app blocking during focus sessions. This is important to understand:

• App blocking preferences are processed entirely on your device by iOS
• We do not receive, store, or transmit information about which apps or categories you block
• Apple's Screen Time system handles all blocking enforcement
• When you select apps or categories to block, that selection is stored securely by iOS, not by ThenFocus
• We cannot see your app usage, browsing history, or which apps you have installed

Your Control

• You can disable app blocking at any time in iOS Settings > Screen Time
• Removing Screen Time permission from ThenFocus immediately unblocks all apps
• You maintain full control over the blocking feature at all times

6. Data Storage and Security

Local-First Architecture

All focus session data, preferences, and history reside on your device using iOS secure storage. No ThenFocus servers store your personal session information. Data persists through app updates but is deleted when you remove the app.

Security Measures

• Local data protection via iOS security features
• App sandboxing prevents other apps from accessing your data
• Minimal third-party data transmission (RevenueCat subscription verification only)
• Regular security reviews of our codebase

8. Your Privacy Rights

You have the right to know what information is collected, request deletion of your data, opt-out of sales (we never sell data), and receive equal service regardless of exercising privacy rights.

European Privacy Rights (GDPR)

You have rights to access, rectification, erasure, processing restriction, data portability, and objection to processing. Contact privacy@houseofthen.com to exercise these rights.

10. Children's Privacy

ThenFocus is not directed to children under 13. We do not knowingly collect information from minors. Parents should contact us immediately if they believe their child has provided personal data.

11. Data Retention

Local Data: Remains on your device indefinitely until you delete it. Deleted data cannot be recovered.

Support Communications: Retained for service quality and legal compliance, then deleted unless legally required.

Subscription Records: Managed by RevenueCat per their retention policies.

12. Changes to This Policy

We may update this policy periodically. When changes occur, we will update the "Last Updated" date and provide in-app notification for significant changes. Continued use after changes constitutes acceptance.
