Agreement to Terms

By downloading, installing, or using Mimick ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and House of Then, LLC ("Company," "we," "us," or "our"), a Delaware limited liability company.

Description of Service

Mimick is a mobile video recording application designed for creating scripted talking-head content. The App provides:

• Segment-Based Recording: Record video in segments with immediate review and keep/redo decisions
• Timeline Management: Build and organize video segments in a visual timeline
• Teleprompter: Display script text over the camera preview while recording
• Trimming Tools: Edit segment start and end points using waveform visualization
• Export: Combine segments into a single video file at 1080p or 4K resolution
• Remote Control Support: Use volume buttons or Bluetooth remotes to control recording

The App is designed as a creative tool for video production. Results may vary based on device capabilities, user skill, and environmental factors.

Account and Registration

Mimick does not require traditional account registration. Your subscription status is managed through your Apple ID and our subscription provider (RevenueCat) using anonymous device identifiers.

You are responsible for:

• Maintaining the security of your Apple ID
• All activity that occurs under your Apple ID related to Mimick
• Ensuring your device meets the minimum requirements for the App

Subscription and Payments

Free Tier

Mimick offers a free tier with limited features, including:

• One active project
• Export at 1080p resolution
• Basic recording and editing features

Premium Subscription

Mimick Premium unlocks additional features and is available through the following options:

• Monthly Subscription: Billed monthly through your Apple ID
• Annual Subscription: Billed annually through your Apple ID
• Lifetime Access: One-time purchase (when available)

Billing and Renewal

• All purchases are processed through Apple's App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage or cancel your subscription in your Apple ID settings
• No refunds are provided for partial subscription periods

Price Changes

We reserve the right to change subscription prices. Any price changes will take effect at the start of your next billing cycle, and you will be notified in advance.

User Responsibilities

By using Mimick, you agree to:

• Use the App in compliance with all applicable laws and regulations
• Not record, create, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not circumvent, disable, or interfere with security features or premium feature restrictions
• Not use the App to infringe on the intellectual property rights of others
• Not use the App for any commercial purpose that violates these Terms
• Take responsibility for all content you create using the App

You acknowledge that you are solely responsible for the content you record and share using Mimick.

Intellectual Property

Our Intellectual Property

The App, including its design, features, code, graphics, user interface, and documentation, is owned by House of Then, LLC and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal or commercial video creation purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute the App
• Use our trademarks or branding without written permission
• Create derivative works based on the App
• Sublicense or transfer your rights to use the App

Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate such feedback into the App without compensation or attribution.

Your Content

Ownership

You retain full ownership of all video content, projects, teleprompter scripts, and other materials you create using Mimick. We do not claim any ownership rights to your content.

License to Us

We do not require any license to your content. Your videos are stored locally on your device and are never transmitted to our servers.

Responsibility

You are solely responsible for:

• The content you create and share
• Obtaining necessary permissions for any third-party content (music, images, etc.) you incorporate
• Ensuring your content complies with applicable laws and platform terms of service where you share it

Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Mimick, you acknowledge that you have read and understood our Privacy Policy.

Third-Party Services

Mimick integrates with third-party services:

• Apple App Store: For purchases and subscriptions
• Apple Photos: For saving exported videos
• RevenueCat: For subscription management

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

Disclaimers

"As Is" Provision

MIMICK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF RESULTS

No Guarantees

We do not guarantee that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected

Technical Limitations

Video recording and export quality depend on your device's hardware capabilities, available storage, and other factors outside our control.

Limitation of Liability

Maximum Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HOUSE OF THEN, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• ANY DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP

Liability Cap

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless House of Then, LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create, share, or distribute using the App

Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of these Terms
• For material changes, we will notify you through the App or other reasonable means
• Your continued use of the App after changes constitutes acceptance of the modified Terms

If you do not agree to the modified Terms, you must stop using the App.

Termination

By You

You may stop using Mimick at any time by deleting the App from your device and canceling any active subscription through your Apple ID settings.

By Us

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or third parties
• Is fraudulent or illegal

Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• You remain responsible for any obligations incurred before termination
• Provisions that by their nature should survive termination will survive (including intellectual property, disclaimers, limitations of liability, and dispute resolution)

Dispute Resolution and Arbitration

Informal Resolution

Before initiating any formal dispute resolution, you agree to contact us at support@houseofthen.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the App that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.

Class Action Waiver

YOU AND HOUSE OF THEN, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions

This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against us on your behalf.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to support@houseofthen.com within 30 days of first downloading the App. Your notice must include your name, address, and a clear statement that you wish to opt out of this arbitration agreement.

General Provisions

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and House of Then, LLC regarding the App and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or strikes.

Our Privacy Promise

Your video content is yours alone. Mimick is designed with a local-first approach—your recordings, projects, and creative work remain on your device by default. We collect only what's necessary to make the app function and improve your experience.

Information We Collect

Information You Provide

• Video Content: All video segments, projects, and recordings you create within Mimick
• Project Data: Project names, teleprompter scripts, segment metadata, and editing preferences
• Camera Settings: Your preferred camera direction, exposure settings, and recording configurations
• Purchase Information: If you subscribe to Mimick Premium, transaction details are processed by Apple and our subscription provider

Information Collected Automatically

• Device Information: Device model, operating system version, and app version for compatibility and troubleshooting
• Crash Reports: Anonymous crash logs to help us identify and fix bugs
• Basic Usage Data: App launch events and feature usage patterns (no video content is ever transmitted)

Information We Do NOT Collect

• Location data or GPS coordinates
• Contacts or address book information
• Browsing history
• Biometric data
• Audio or video content (your recordings never leave your device unless you explicitly export and share them)
• Personal identifiers beyond what's necessary for subscription management

How We Use Your Information

Core App Functionality

• Store your video projects and segments locally on your device
• Apply your camera and teleprompter preferences
• Process and export your videos
• Manage your trim points and timeline edits

App Improvement

• Analyze crash reports to fix bugs and improve stability
• Understand feature usage patterns to prioritize development
• Ensure compatibility across different iOS devices and versions

Subscription Management

• Verify your premium subscription status
• Process subscription purchases through Apple's App Store
• Restore purchases across your devices

Data Storage and Security

Local Storage

All your video content, projects, and creative work are stored locally on your iOS device:

• Video segments are saved in the app's Documents directory
• Project metadata is stored in a local SQLite database
• Your preferences are saved using iOS secure storage

iOS Security Features

Mimick benefits from iOS built-in security protections:

• App sandboxing prevents other apps from accessing your Mimick data
• Device encryption protects your data when your device is locked
• Face ID/Touch ID protection at the device level

Export and Sharing

When you export a video:

• The exported file is saved to your Photos library
• You control who sees your content through iOS sharing features
• We never have access to your exported videos

Third-Party Services

Mimick integrates with limited third-party services, each with their own privacy practices:

Apple Services

• App Store: Handles purchases and subscriptions
• Photos Library: Receives your exported videos (with your permission)
• iCloud: May back up app data if you have iCloud Backup enabled

Your Rights and Choices

Access and Control

You have full control over your data:

App Permissions

You can manage Mimick's permissions in iOS Settings:

• Camera: Required for recording video
• Microphone: Required for recording audio
• Photos: Required only for saving exported videos

California Residents (CCPA)

If you are a California resident, you have the right to:

• Know what personal information we collect
• Request deletion of your personal information
• Opt-out of the sale of personal information (we do not sell your data)
• Non-discrimination for exercising your privacy rights

European Users (GDPR)

If you are in the European Economic Area, you have additional rights:

• Access to your personal data
• Rectification of inaccurate data
• Erasure of your data
• Restriction of processing
• Data portability
• Object to processing

Children's Privacy

Mimick is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at support@houseofthen.com, and we will take steps to delete such information.

Data Retention

Local Data

Your video projects and recordings remain on your device until you delete them. We do not automatically delete your content.

Subscription Data

Subscription-related information is retained by Apple and RevenueCat according to their respective retention policies and legal requirements.

Crash Reports

Anonymous crash reports are retained for up to 90 days to help us identify and resolve issues.

International Users

Mimick is operated from the United States. If you access the app from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated.

By using Mimick, you consent to the transfer of your information to the United States and acknowledge that the data protection laws may differ from those of your country.

Changes to This Policy

We may update this Privacy Policy from time to time. When we make changes:

• We will update the "Last Updated" date at the top of this policy
• For significant changes, we will notify you through the app or via other means
• Your continued use of Mimick after changes constitutes acceptance of the updated policy
